Obligation
We may process
information where necessary to comply with a legal or regulatory obligation.
6.3 Consent
We may rely on
your consent where consent is required or appropriate for a particular

consent does not affect the lawfulness of processing carried out before
withdrawal.
6.4
Legitimate Interests
Where
applicable, we may process information where reasonably necessary for
legitimate interests pursued by Clover Academy or another party, provided those
interests are not overridden by applicable rights and interests.
Examples may
include maintaining platform security, preventing misuse and improving our
services.
7. DATA MINIMISATION AND ACCURACY
Clover Academy seeks to follow the principles of data minimisation, purpose limitation, accuracy, openness and accountability.
We seek to collect information relevant to identified purposes, avoid collecting unnecessary personal information, keep information reasonably accurate and up to date, use information only for legitimate and identified purposes, and retain information only for as long as reasonably necessary or legally required.
If you become aware that information, we hold about you is inaccurate, you may request that we correct it.
8. HOW WE SHARE PERSONAL INFORMATION
Clover Academy does not sell personal information.
We may disclose personal information where reasonably necessary to provide our services, operate our platform, process payments, comply with law or protect our legitimate interests.
8.1 Instructors and Facilitators
Relevant information may be accessible to authorised instructors or facilitators where necessary to deliver instruction, assess assignments, monitor learning progress, provide feedback, or provide learner support.
8.2 Payment Processing with Paystack
Clover Academy uses Paystack to process online payments.
Paystack may process payment and transaction information necessary to provide payment services, including payment processing, refunds, disputes, fraud prevention and related payment functions.
Where Paystack processes merchant personal data on Clover Academy’s behalf, Paystack acts as a data processor in accordance with the applicable data processing arrangements.
Paystack may also use service providers and subprocessors in providing its services.
For information about Paystack’s own processing practices, users may review Paystack’s applicable privacy policy and terms.
8.3 Other Technology and Service Providers
We may use third party providers to support functions such as website hosting, cloud services, email and communications, security, analytics, technical support, data storage, and other operational services.
We seek to ensure that service providers receive only information reasonably necessary for the services they provide and, where appropriate, are subject to contractual or other safeguards concerning confidentiality and data protection.

8.5 Business Transactions
If Clover Academy is involved in a merger, acquisition, restructuring, sale of assets, financing, reorganisation or similar transaction, personal information may be transferred as part of that transaction where legally permitted.
Where required, appropriate safeguards and notices will be provided.
9. INTERNATIONAL DATA PROCESSING
Clover Academy operates online and may use service providers located in countries other than the country in which you reside.
As a result, personal information may be processed or stored internationally.
This may include information processed through third party services used to operate our website, learning platform or payment infrastructure.
Where applicable, Clover Academy will take reasonable steps to ensure that international transfers are conducted in accordance with applicable data protection requirements.
Where the GDPR applies, we will use an appropriate transfer mechanism where required, such as an applicable adequacy decision, appropriate contractual safeguards, Standard Contractual Clauses where applicable, or another lawful transfer mechanism recognised under applicable data protection law.
10. DATA SECURITY
Clover Academy takes reasonable technical and organisational measures designed to protect personal information against unauthorised access, unauthorised disclosure, loss, misuse, alteration, destruction, and other unlawful or unauthorised processing.
Depending on our actual systems and services, safeguards may include encrypted communications, access controls, password protection, role-based access, system and platform security controls, backups, administrative controls, and other reasonable technical and organisational measures.
Access to personal information is intended to be limited to individuals and service providers who reasonably require access for legitimate purposes.
No internet transmission or electronic storage system can be represented as completely secure. We therefore seek to maintain and improve appropriate security measures as our services develop.
11. DATA SECURITY INCIDENTS AND BREACHES
If Clover Academy becomes aware of a suspected or confirmed personal data security incident, we will take reasonable steps to investigate the incident, contain and mitigate its effects, assess the nature and scope of the incident, take appropriate corrective measures, and make notifications where required by applicable law.
Where notification to a data protection authority or affected individuals is legally required, we will make the notification in accordance with applicable requirements.
Where an incident involves a third-party provider, including a payment provider, we may work with that provider to investigate and respond to the incident in accordance with applicable contractual and legal requirements.
12. DATA RETENTION
Clover Academy does not retain personal information indefinitely.
We determine retention periods by considering the purpose for which the information was collected, the nature and sensitivity of the information, whether the learner maintains an active account, the continuing need to provide or administer services, legal, accounting, tax or regulatory requirements, dispute resolution requirements, security and fraud prevention requirements, and the need to maintain accurate educational or certificate records.
Payment and transaction records may be retained for as long as reasonably necessary for accounting, reconciliation, refunds, dispute resolution, fraud prevention and applicable legal or regulatory requirements.
Where personal information is no longer required, we will seek to delete, securely dispose of or anonymise it, subject to applicable legal and legitimate operational requirements.
13. ACCOUNT CLOSURE AND DELETION
You may request closure or deletion of your account by contacting us.
Where appropriate, we will delete or anonymise personal information associated with the account.
However, account deletion does not necessarily require immediate deletion of every record.
We may retain information where necessary to comply with a legal obligation, maintain financial or accounting records, resolve disputes, prevent fraud or abuse, establish or defend legal claims, maintain certificate verification records, or fulfil another legitimate purpose permitted by applicable law.
Where information is retained, we will seek to limit its use to the purpose for which it remains necessary.
14. YOUR PRIVACY RIGHTS
Depending on your location and applicable law, you may have the right to be informed about how your personal information is collected and processed, the right to access personal information held about you, the right to request correction of inaccurate or incomplete information, and the right to request deletion of personal information in circumstances where applicable law provides this right.
You may also have the right to object to certain processing of your personal information, request restriction of processing in certain circumstances, request certain personal information in a structured and commonly used format where applicable, withdraw consent where processing is based on consent, and object to the processing of your personal information for direct marketing purposes.
Where applicable law provides protections against decisions based solely on automated processing that produce legal or similarly significant effects, you may have additional rights concerning such processing.
15. HOW TO EXERCISE YOUR RIGHTS
To make a privacy request, contact privacy@clodemy.com.
Your request should provide sufficient information for us to understand what you are requesting.
We may request reasonable information to verify your identity before releasing or changing personal information.
We will handle requests within the time required by applicable law.
Some rights are subject to legal limitations or exemptions. Where we are unable to comply with a request, we will explain the reason where required by applicable law.
16. MARKETING COMMUNICATIONS
Where Clover Academy sends marketing communications, you may opt out at any time.
You may unsubscribe using the mechanism provided in the relevant communication or contact us at the privacy email address provided in this policy.
An individual who opts out of marketing may continue to receive essential communications relating to account security, passwords, transactions, course enrolment, course access, important service changes, and other communications necessary to provide services requested by the learner.
17. LEARNER SUBMISSIONS AND EDUCATIONAL CONTENT
Learners may submit assignments, projects, questions, feedback and other educational materials through Clover Academy.
Such information may contain personal information.
Access to learner submissions will be limited to authorised persons who reasonably require access for educational, administrative, assessment, support or other legitimate purposes.
Clover Academy will not knowingly publish a learner’s private educational submission publicly without an appropriate lawful basis or permission where permission is required.
18. CERTIFICATES AND VERIFICATION
Where Clover Academy issues certificates, certificates and associated records may contain personal information.
We may retain information reasonably necessary to confirm course completion, maintain accurate educational records, prevent fraudulent claims, verify certificates, and respond to legitimate certificate verification requests.
Where a certificate verification service is publicly available, Clover Academy will seek to limit the information displayed publicly to information reasonably necessary for verification.
19. COOKIES AND SIMILAR TECHNOLOGIES
Clover Academy may use cookies and similar technologies to operate, secure and improve our website and online learning platform.
Depending on the technologies actually used, cookies may be used for authentication, login and session management, security, remembering preferences, website functionality, performance measurement, analytics, and other purposes disclosed through our cookie controls.
Some cookies may be necessary for the website or learning platform to function.
Where consent is legally required for non essential cookies, Clover Academy will provide an appropriate mechanism for obtaining and managing that consent.
You may also control certain cookies through your browser settings.
Disabling essential cookies may affect the functionality of the website or learning platform.
Clover Academy may maintain a separate Cookie Policy containing more detailed information about the cookies and similar technologies used on our services.
20. CHILDREN AND MINORS
Clover Academy is primarily designed to provide educational and professional development services.
Because different countries apply different rules to children and minors, the treatment of a learner’s information may depend on the learner’s age, location and the nature of the service being provided.
Where applicable law requires parental or guardian consent for the processing of a child’s personal information, Clover Academy will seek to obtain or otherwise rely on the appropriate lawful basis before processing that information.
We do not knowingly seek to collect children’s personal information for purposes that are prohibited by applicable law.
If you believe that a child has provided personal information to Clover Academy in circumstances where the necessary consent or other lawful basis was not obtained, please contact us.
21. SENSITIVE OR SPECIAL CATEGORIES OF INFORMATION
Clover Academy does not intend to collect sensitive personal information unless it is reasonably necessary for a legitimate purpose and permitted under applicable law.
If a particular service requires the collection or processing of sensitive information, we will seek to provide appropriate notice and apply additional safeguards where required.
Users should avoid submitting sensitive personal information through assignments, forms, messages or other areas of the platform unless it is specifically requested or necessary for the relevant educational service.
22. THIRD PARTY SERVICES AND LINKS
Clover Academy may use third party services and may provide links to external websites.
Third party services may have their own privacy policies and terms.
We are not responsible for the privacy practices of third-party websites or services that we do not control.
Where third party providers process personal information on our behalf, we seek to use appropriate contractual, organisational and technical safeguards consistent with applicable requirements.
For payment services provided through Paystack, Paystack’s own applicable privacy policy and terms govern Paystack’s processing activities.
23. PRIVACY BY DESIGN AND DEFAULT
Where reasonably practicable, Clover Academy seeks to incorporate privacy and data protection considerations into the design and operation of its services.
This may include limiting unnecessary data collection, restricting access to personal information, applying appropriate security controls, retaining information only as necessary, and considering privacy implications when introducing new technologies or services.
24. DATA PROTECTION GOVERNANCE
Clover Academy recognises that responsible data protection involves more than publishing a Privacy Policy.
Where applicable, Clover Academy will take appropriate organisational steps concerning data protection registration, data protection responsibilities, staff awareness and training, data security, records and procedures, data subject requests, third party service providers, incident management, and periodic review of data protection practices.
This Privacy Policy does not itself constitute evidence that Clover Academy has completed any registration, certification, training or other regulatory requirement.
25. DATA PROTECTION AUTHORITY AND COMPLAINTS
If you believe that your personal information has been processed unlawfully or that your privacy rights have been violated, you may first contact Clover Academy so that we can investigate and respond.
You may also have the right to lodge a complaint with the relevant data protection authority in your jurisdiction.
For individuals in Ghana, the relevant regulator is the Data Protection Commission of Ghana, established under the Data Protection Act, 2012 (Act 843).
26. CHANGES TO THIS PRIVACY POLICY
Clover Academy may update this Privacy Policy from time to time.
Changes may be necessary because of changes to our services, changes to our technology, changes to our data processing practices, changes to third party services, or changes in applicable law or regulatory requirements.
When we update the policy, we will change the Last Updated date at the beginning of the document.
Where appropriate, we may also provide notice through our website, learning platform, email or another suitable communication channel.
We encourage you to review this Privacy Policy periodically.
